HOUSE CONCURRENT RESOLUTION NO. 41

Requesting that the Joint Committee on Government and Finance
conduct a study of the feasability of creating a State
retirement system for fireman, police officers and emergency
medical services personnel.

Whereas, A number of fire and police departments and EMS
personnel are currently under the State Public Employee Retirement
System, and other fire and police departments are under local
retirement systems; and

Whereas, Having fire, police, and EMS personnel participating
in different retirement systems results in inequities to certain
participants in the various systems; and

Whereas, Creating a State Retirement system for fire, police
and EMS personnel may improve benefits and solvency for existing
municipal plans; and

Whereas, The West Virginia Legislature believes that a thorough
examination of the feasability of creating a State retirement
system for fire, police and EMS personnel would be prudent and advantageous in assisting the Legislature to make sound fiscal and
policy decisions about the future of the State's various retirement
systems; therefore, be it;

Resolved by the Legislature of West Virginia:

That the Joint Committee on Government and Finance is hereby
requested to study the feasability of creating a State retirement
system for fire, police and EMS personnel in its ongoing study of
solutions to problems with municipal pension plans; and, be it

Further Resolved, That the committee shall report to the
Legislature its findings, conclusions and recommendations, together
with drafts of any legislation necessary to effectuate its
recommendations, no later than the first day of January, two
thousand two; and, be it

Further Resolved, That the expenses necessary to conduct the
study and to prepare appropriate reports, recommendations and
proposed legislation be paid from legislative appropriations to the
Joint Committee on Government and Finance
